Kontras.id (Kabupaten Gorontalo) – Soal hasil putusan Dewan Kehormatan Penyelenggara Pemilu (DKPP), Tokoh Pemuda Tapa Luluo, Kecamatan Telaga Biru, Kabupaten Gorontalo, Yosep Ismail meminta agar Pasangan Calon lainnya jangan dulu terlalu bermimpi.
“Paslon lain jangan terlalu bermimpi, ini baru putusan DKPP belum keputusan MK. Putusan DKPP itu hanya membenarkan bahwa Bawaslu memberikan rekomendasi berdasarkan regulasi. Tidak sesuai dengan asumsi yang berkeliaran saat ini,” tegas Yosep kepada Kontras.id via telepon, Rabu 13/01/2021
Menurut Yosep, keputusan DKPP hanya menjadi bahan pertimbangan hukum oleh MK, baik bukti materil maupun formil.
“Artinya ini sudah menjadi putusan lembaga, jadi antar lembaga negara paling tidak saling menghargai,” tutur Yosep.
Yosep menegaskan, MK sebagai lembaga negara tidak mungkin tidak menghargai lembaga negara lainnya. Soal putusan MK bagaimana, kata Yosep itu urusan MK. Tetapi, paling tidak MK juga menghargai lembaga negara yang sudah memberikan putusannya dan menyatakan KPU Kabupaten Gorontalo bersalah.
“Ini sudah nyata, bahwa dewan penyelenggara tertinggi sudah menyatakan bahwa KPU itu tidak berintegritas. Sehingga KPU tau dirilah. Sudah menyalahi kode etik ya kalau boleh mundurlah. Artinya integritas daripada KPU di pertanyakan,” tegas Yosep.
“Tetapi, kita minta kepada MK untuk memutuskan berdasarkan ketentuan yang berlaku, dan juga mempertimbangkan putusan lembaga lain. Sesama lembaga negara paling tidak saling menghargai,” pungkas Yosep.
